    1. Description:
      1. Type of procedure:
        Open procedureJustification:

        Działając na podstawie art. 43 ust. 2b pkt. 2 Zamawiający podejmuje decyzję o skróceniu terminu składnia ofert, który wyniesie 20 dni.

        Decyzja Zamawiającego podyktowana jest względami organizacyjnymi oraz technicznymi. Skrócenie terminu składania ofert spowodowane jest wyprzedzeniem przez Wykonawcę robót budowlanych założonego harmonogramu, który początkowo zakładał zakończenie robót na październik 2018 roku. W obecnym momencie roboty budowlane mają być zakończone w sierpniu 2018 roku, co powoduje pilną konieczność zabezpieczenia Kliniki Chorób Wewnętrznych, Nefrologii i Dializoterapii w niezbędne meble medyczne, meble biurowe oraz wyposażenie medyczne.

        W związku z powyższym skrócenie terminu składnia ofert jest jak najbardziej zasadne.

                1. Wykonawcom, a także innym podmiotom, jeżeli ich interes prawny w uzyskaniu zamówienia doznał lub może doznać uszczerbku w wyniku naruszenia przez Zamawiającego przepisów ustawy, przysługują środki ochrony prawnej opisane w Dziale VI ustawy.

                2. Na podstawie art. 180 ust. 1 Wykonawcy przysługuje odwołanie wyłącznie od niezgodnej z przepisami

                ustawy czynności Zamawiającego podjętej w postępowaniu o udzielenie zamówienia lub zaniechania

                czynności, do której Zamawiający jest zobowiązany na podstawie ustawy.

                3. Odwołanie wnosi się do Prezesa Krajowej Izby Odwoławczej w terminach określonych odpowiednio w art. 182 ustawy. Odwołujący przesyła kopię odwołania Zamawiającemu przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.

                4. Na orzeczenie Krajowej Izby Odwoławczej stronom oraz uczestnikom postępowania przysługuje skarga

                do sądu. Skargę wnosi się do sądu okręgowego właściwego dla siedziby Zamawiającego za pośrednictwem Prezesa Krajowej Izby Odwoławczej, w terminie 7 dni od dnia doręczenia orzeczenia, przesyłając jednocześnie jej odpis przeciwnikowi skargi.
