                                                                Środki ochrony prawnej przysługują Wykonawcy, jeżeli ma lub miał interes w uzyskaniu zamówienia oraz poniósł lub może ponieść szkodę w wyniku naruszenia przez Zamawiającego przepisów ustawy PZP;

                                                                1. Informacja o niezgodnej z przepisami ustawy PZP czynności:

                                                                1.1 Wykonawca może w terminie przewidzianym do wniesienia odwołania poinformować Zamawiającego o niezgodnej z przepisami ustawy PZP czynności podjętej przez niego lub zaniechaniu czynności, do której jest on zobowiązany na podstawie ustawy PZP, na które nie przysługuje odwołanie.

                                                                1.2 W przypadku uznania zasadności przekazanej informacji Zamawiający powtarza czynność albo dokona czynności zaniechanej, informując o tym Wykonawców w sposób przewidziany w ustawie PZP dla tej czynności; na powyższe nie przysługuje odwołanie.

                                                                2. Odwołanie przysługuje wyłącznie od niezgodnej z przepisami ustawy czynności Zamawiającego podjętej w postępowaniu o udzielenie zamówienia lub zaniechania czynności, do której Zamawiający jest zobowiązany na podstawie ustawy:

                                                                2.1. Jeżeli wartość zamówienia jest mniejsza niż kwoty określone w przepisach wydanych na podstawie art. 11 ust. 8 ustawy PZP, odwołanie przysługuje wyłącznie wobec czynności:

                                                                1) wyboru trybu negocjacji bez ogłoszenia, zamówienia z wolnej ręki lub zapytania o cenę;

                                                                2) określenia warunków udziału w postępowaniu;

                                                                3) wykluczenia odwołującego z postępowania o udzielenie zamówienia;

                                                                4) odrzucenia oferty odwołującego;

                                                                5) opisu przedmiotu zamówienia;

                                                                6) wyboru najkorzystniejszej oferty.

                                                                2.2 Zamawiający przesyła niezwłocznie, nie później niż w terminie 2 dni od dnia otrzymania, kopię odwołania innym Wykonawcom uczestniczącym w postępowaniu o udzielenie zamówienia, a jeżeli odwołanie dotyczy treści

                                                                Ogłoszenia o zamówieniu lub postanowień SIWZ, zamieszcza ją również na stronie internetowej, na której jest zamieszczone ogłoszenie o zamówieniu lub jest udostępniona SIWZ, wzywając Wykonawców do przystąpienia do postępowania odwoławczego.

                                                                2.3 Wykonawca może zgłosić przystąpienie do postępowania odwoławczego w terminie 3 dni od dnia otrzymania kopii odwołania, wskazując stronę, do której przystępuje, i interes w uzyskaniu rozstrzygnięcia na korzyść strony, do której przystępuje.

                                                                2.4 O oddaleniu odwołania lub jego uwzględnieniu Izba orzeka w wyroku.

                                                                2.5 Odwołanie wnosi się do Prezesa Izby przesyłając jego kopię Zamawiającemu przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.

                                                                2.6 Odwołanie wnosi się w terminach określonych w art. 182 ustawy PZP.

                                                                3. Skarga do sądu:

                                                                3.1 Na orzeczenie Izby stronom oraz uczestnikom postępowania odwoławczego przysługuje skarga do sądu.

                                                                1.1. Skargę wnosi się za pośrednictwem Prezesa Izby w terminie 7 dni od dnia doręczenia orzeczenia Izby, przesyłając jednocześnie jej odpis przeciwnikowi skargi.

                                                                1.2. Prezes Izby przekazuje skargę wraz z aktami postępowania odwoławczego właściwemu sądowi w terminie 7 dni od dnia jej otrzymania.

                                                                1.3. Skarga powinna czynić zadość wymaganiom przewidzianym dla pisma procesowego oraz zawierać oznaczenie zaskarżonego orzeczenia, przytoczenie zarzutów, zwięzłe ich uzasadnienie, wskazanie dowodów, a także wniosek o uchylenie orzeczenia lub zmianę orzeczenia w całości lub części.

                                                                1.4. Sąd rozpoznaje sprawę niezwłocznie, nie później jednak niż w terminie 1 miesiąca od dnia wpływu skargi do sądu.

                                                                1.5. Od wyroku sądu lub postanowienia kończącego postępowanie w sprawie nie przysługuje skarga kasacyjna.
