    Zgodnie z art. 43 ust. 2b Pzp, Zam może wyznaczyć termin skłd ofert krótszych niż termin określony w ust.2, nie krótszy niż 15 dni, m. in. jeśli zachodzi pilna potrzeba udziel zam i skr terminu składania ofert jest uzasadnione. Ze względu na zwiększenie środków finansowych przeznaczonych dla Kliniki Chirurgii Ogólnej i Naczyniowej w IV kwartale 2017 roku w zakresie „chirurgia naczyniowa hospitalizacja II stopień referencyjny” oraz „chirurgia naczyniowa hospitalizacja II poziom referencji- Q01, Q52” ilość wymienionych stengraftów gwarantowana w dotychczas obowiązujących umowach jest niewystarczająca dla prawidłowej realizacji kontraktu do końca bieżącego roku.
    
    Przepisu art.43 ust. 2b pkt 2 Pzp nie jest uzależnione od tego czy pilna potrzeba wynikała z przyczyn leżących po stronie zamawiającego, a także od tego czy zaistnienie pilnej potrzeby można było wcześniej przewidzieć.
