            1. Środki ochrony prawnej określone w dziale VI PZP przysługują Wykonawcy, a także innemu podmiotowi jeżeli ma lub miał interes w uzyskaniu danego zamówienia oraz poniósł szkodę w wyniku naruszenia przez zamawiającego przepisów ustawy Prawo Zamówień Publicznych.

            2. Odwołanie wnosi się w terminie określonym w art. 182 PZP.

            3. Odwołanie wnosi się do Prezesa Izby w formie pisemnej lub elektronicznej opatrzonej bezpiecznym podpisem elektronicznym weryfikowanym za pomocą ważnego kwalifikowanego certyfikatu. Odwołujący przesyła kopię odwołania Zamawiającemu przed upływem terminu na wniesienie odwołania, w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.
